Content Moderation Policy

HellaPrints is an open marketplace platform designed to empower independent designers and creators. To ensure a safe, legal, and trustworthy shopping environment for all Buyers and to maintain compliance with global advertising and intellectual property standards, all uploaded content (Art/Content) must strictly adhere to the standards outlined in this Content Moderation Policy, as well as our full Terms of Service (TOS) and Intellectual Property Policy.

We use a combination of automated detection tools, proprietary algorithms, and human review processes to actively monitor content and respond swiftly to external complaints.

I. Artist Accountability and Content Standards

By submitting Art or Content to the HellaPrints marketplace, the Artist (Seller) agrees to the following core responsibilities:

  1. Originality and Rights: You represent and warrant that you are the sole owner of all intellectual property rights (including copyrights and trademarks) in the Content, or that you have obtained all necessary licenses and permissions to reproduce, sell, and offer the Content on physical Products worldwide.

  2. Accuracy: All information related to the Content, including product description, tags, and claims, must be accurate and truthful.

  3. Compliance: Your Content must comply with all applicable local, state, federal, and international laws.

II. Prohibited Content (Zero Tolerance Violations)

Content is strictly prohibited if it is illegal, harmful, or grossly violates the rights of others. Such content will be removed immediately upon detection, and the related account may face immediate suspension without warning.

III. Restricted Content (Allowed with Limitations)

Content is Restricted if it is subject to legal or regulatory controls (e.g., age or geographic restrictions). This content may be permissible but cannot be advertised in all jurisdictions and requires strict compliance.

Alcohol & Tobacco Content promoting the consumption or sale of alcoholic beverages or tobacco/vaping products must comply with all local laws and age verification requirements.
Gambling & Healthcare Content related to online gambling, specific pharmaceuticals, or complex medical devices.
Political Content Content related to political campaigns, issues of public interest, or sensitive social issues may be subject to geographic restrictions and disclosure requirements.

 

IV. Enforcement and Moderation Procedures

4.1. Detection and Action

HellaPrints monitors content both pre-sale and post-sale. Actions taken depend on the nature and severity of the violation:

Content/Product Takedown Immediate removal for clear violations (e.g., IP infringement, Hate Speech, illegal conduct).
Account Warning Minor policy violations or upon first notice of potential IP violation, giving the Artist a chance to rectify the issue.
Account Suspension/Termination Severe violations of Prohibited Content policy (e.g., counterfeiting) or adherence to the Repeat Infringer Policy.

 

4.2. Intellectual Property (DMCA) Enforcement

Our platform is protected by the DMCA (Digital Millennium Copyright Act). We implement the following mandatory procedures to manage IP disputes:

  • Takedown Notices: Upon receipt of a legally compliant DMCA notice of infringement, HellaPrints will promptly remove or disable access to the challenged Content.

  • Counter-Notices: Artists whose content is removed due to a DMCA notice may submit a Counter-Notice if they believe the removal was a mistake. HellaPrints will follow the strict 10–14 day DMCA procedure regarding counter-notices.

  • Repeat Infringer Policy: Any Artist who repeatedly infringes the copyrights or trademarks of others will have their account permanently suspended or terminated.

4.3. Appeal Process

If an Artist believes their content was removed or their account was suspended in error, they may submit an appeal to support@hellaprints.com. Appeals must clearly state the issue, the policy section in dispute, and provide evidence supporting the claim of non-violation.
